My Earthy Kiss is committed to protecting the privacy rights of its customers and strictly complies with the requirements of the Personal Data (Privacy) Ordinance of the Hong Kong Special Administrative Region (Cap. 486) (the ordinance). All customer information (including accounts, transactions and related communications) obtained through this website will be treated confidentially. The term "personal data" in this statement has the meaning as interpreted in the Ordinance.

Collection of personal data

When you sign up for My Earthy Kiss membership, or when you purchase from us, or request services, your personal information may be asked to provide, such as (but not limited to) title, name, date of birth, telephone number, email address, residential address, credit card information and bank account number, education level, occupation, family income, interests and hobbies, etc.

The information you provide us with about yourself is voluntary. If you choose not to provide such information you may be denied access to certain parts of the site, or we may be unable to process your membership application or offer you products or services.

The main purpose of obtaining personal data

You consent to the use of your personal data by us for the following purposes (or other purposes directly related to those purposes) and other purposes, for which we agree with you, or as may be required by law from time to time:

A.    Providing products, services and administrative work related to your member's account;

B.    Processing your membership application;

C.     Processing of offers derived from or related to the Services;

D.    Processing payments, direct debit arrangements and/or credit arrangements; and

E.     Advertise and promote the goods and services we offer to you, such as sending you news, events, offers and promotional materials about our products and services (see "Direct Sales" below); Convenient for us to communicate with you. From time to time, we may also use non-identifying statistics about our customers to design and improve our goods and services more effectively. The information will not disclose the identity of any individual. In accordance with the Ordinance, the company will comply with the request of individuals and will not use their personal data for direct marketing purposes. If you do not wish to receive direct mail from us, please write to our Privacy Officer at the following address. The company may use the personal data collected for general marketing purposes unless otherwise instructed to do so in the manner described above.

Direct marketing purposes

For the purpose of direct marketing purposes, we propose:

1.     Use your name and contact information; and

2.     Promote our products, services and related activities. However, we will not use and/or provide your personal data in this way unless exempted by the Ordinance or we have received prior consent. You may contact our Data Privacy Officer at any time to discontinue the use of any of your personal data for any of the above direct marketing purposes.

Protection of personal data

All personal data you provide to us will be stored securely,  and will only be accessed and processed by some authorised staff. All personal data you submit through our website is encrypted during transmission to protect your data securely. We may disclose and pass on your information to the following persons (in Hong Kong or overseas) when it is necessary to disclose such information for the purposes for which such information is collected or for other purposes directly related to such purposes:

A.    Organisations (including Hong Kong and overseas organisations) to fulfill the purposes for which the information is collected and to provide our business partners (including Hong Kong and overseas organisations) for direct marketing purposes (without breaching any consent required in relation to direct marketing)

B.    Any telecommunications service provider;

C.     Any third-party data collection agents, credit databases, security companies, credit companies, banks, financial institutions;

D.    Any third-party with whom we have entered into a confidential agreement;

E.     Any actual or proposed trustee or assignee of us;

F.     Any of our subsidiaries, holding companies, affiliates, or companies or associates that are owned by or in the same controlling company as us;

G.    Governmental and regulatory agencies, investigative and law enforcement agencies, and other agencies prescribed or authorized by law. Please contact our Privacy Officer if you do not wish your personal data to be disclosed to third parties.

Obtaining and modifying personal data

Under the laws of the Hong Kong Special Administrative Region, you have the following rights:

A.    Check whether we have stored your personal data;

B.    Access to personal data stored by us;

C.     Require us to correct inaccurate personal data;

D.    Determine from time to time the privacy policies we have in place and the types of personal data we store. Under the ordinance, we are entitled to charge customers a reasonable fee for the processing of their personal data that have been stored. All requests for access to or correction of personal data, or requests for policies and procedures relating to personal data, must be made in writing and sent to: cs@earthykiss.com.

Amendment of the privacy policy

We may change this Privacy Policy from time to time. All changes are subject to change without prior notice. Please check this Privacy Policy regularly. (In case of any discrepancy between the English version and the Chinese version, the English version shall prevail.)
