Terms & Conditions

1.0 Order Terms


Customers who accept the online ordering service provided by MY EARTHY KISS (MEK), must agree to, and accept the following terms of the order in order to enjoy the online ordering and delivery service. These terms apply to Hong Kong and other places.

 

2.0 Online Orders


2.1.   Please note that orders cannot be canceled or changed after being placed, due to technical issues. MEK is not responsible for any purchase issues arising from computer systems.

2.2.   If You purchase similar or other goods on the same day after placing an order after one hour, MEK may regard it as another order and charge the relevant postal charges and handling charges (if applicable). Please place Your order correctly.

2.3.   MEK reserves the right to cancel any online orders, even if the computer system indicates that the transaction has already been completed, upon notification to the customer. MEK reserves the final right to accept or reject the order.

2.4.   Please confirm Your name, email address, and telephone number as well as the shipping address when filling in the order form to ensure prompt delivery. MEK shall not be liable for any loss caused by incorrect information provided by the customer.

2.5.   Customers should be responsible for the extra shipping fees caused by any sudden changes in their personal details for their orders.

2.6.   If the customer fails to make payment within one day, the transaction and the order will be canceled automatically.

2.7.   All products for sale are photographed in real objects. Please note that there may be some tiny errors between the actual products and the real objects, due to the environment, lighting, printing, and picture combination during shooting.

2.8.   If the products You received are defective, please go to MY EARTHY KISS Experience Station for an exchange, together with the delivery note and E-receipt within 3 days after the arrival of the goods. If the products are not returned within the time limit, the transaction will be considered successful.

2.9.   Most of the goods for sale are imported in the original package. MEK will do its best to ensure an adequate supply of the goods. MEK will notify our customers separately if there is an occasional shortage of stock. The refund will be completed within one month.

2.10.   Based on tax differences in different countries, the selling price does not include local tariffs or local sales taxes.

2.11.   All goods sold are for the customer's personal use only, and not for any commercial use. MEK reserves the right to reject all orders suspected of commercial use.

2.12.   MEK reserves the right to change all the above and other terms of purchase without prior notice. If the customer does not agree, MEK may terminate the online ordering service without affecting the goods that have already been ordered.

 

Regarding our delivery services, MEK uses SF Express for orders in China, Hong Kong, and Macao, and uses FedEx (or equivalent service provider) for other overseas regions.

 

Your rights in the delivery of goods are governed by the terms and conditions of the relevant company, which you may request to see. If You choose our services, you agree to entrust SF Express or FedEx to handle all the freight matters for You. The company shall not be held responsible for any act or misconduct of the company concerned.

 

If SF Express or FedEx Express or any other service providers of the same level fail to contact You for delivery within 30 days, MEK reserves the right to cancel the order and refund the order amount to you at a charge of HK$50 or 6% of the order fee (to cover the online payment transaction and delivery costs, etc.).


3.0 Shipping fees


Hong Kong Orders:

3.1.   Free shipping for orders over HK$1,200.

3.2.   For items under HK$1,200, customers will have to cover their own shipping fees.

3.3.   The fee only includes the Courier fee for the first delivery of the order. Therefore, if the first delivery is not successful, the second delivery will be arranged, and the Courier fee for that shall be paid by the customer.

3.4.   Team MY EARTHY KISS will normally deliver the package to SF Express within 3 to 4 working days. SF Express will contact you by phone to confirm the delivery date and time. For any queries about courier, please contact SF Express at +852 2730 0273.

3.5.   Please go to the FAQ section (Delivery) for queries regarding the tracking number.

 

4.0 In-Store Pick-Up Policy


Once you have successfully placed an order and received an order confirmation email from

My Earthy Kiss, You are welcome to pick up Your order(s) at My Earthy Kiss Experience Station at any time during our business hours.

 

A demurrage charge of HK$10 per day may occur if you do not collect your goods within 12

working days, starting from the working day after your order(s) is/are placed. Kindly schedule to come at your earliest convenience.

5.0 Shipping for Overseas Orders


5.1.   If the goods are shipping outside of Hong Kong, You will be regarded as local importers. Consequently, You may need to pay taxes, or regarding the goods to the destination register or apply for an import license, these fees and documents claims are depending on the laws of the destination. MY EARTHY KISS is not able to control or expect the number of such fees. MY EARTHY KISS will not be liable for any such payment or documentation. If You have any queries about the import duties and laws, please contact the customs in Your country.

5.2.   By clicking "Confirm" to complete the order, you accept and accept responsibility for all surcharges, taxes, or import document claims for shipping the ordered goods.

5.3.   Using FedEx or a similar service provider will also delay the delivery time due to customs inspection and taxes at the destination. Please note that the addressee is solely responsible for all customs matters and duties.

5.4.   If the goods cannot be delivered to the customer for any reason, or are returned by customs, We can only refund the price of the goods as stated in the order, but not the shipping fees.

5.5.   The company will not be responsible for any delay, loss, damage, or theft, and We reserve the right of not issuing refunds. Customers are advised to call your local courier company’s customer service hotline for any complaints.

5.6.   If the item is rejected and returned to MY EARTHY KISS, We will charge for the shipping (including inbound and return shipping), handling fee and return order processing fee (20% of the total order amount). The balance will be returned to the customer after deducting all relevant fees.

 

*As the surcharge payment, all kinds of taxes, or regarding the goods to the destination register or apply for import licenses are involved in the local countries, such as the entrance of the law, We are required to state the exact value of the goods, and in some countries, it is necessary to attach a document containing details of the goods, including the value of the goods, to the package for customs clearance purposes. Therefore, under no circumstances We may not be able to adjust the value of the goods in the customs declaration documents as required by the customer.

 

Arrangements during Covid-19: the delivery time will depend on actual conditions. In case of any delay in delivery due to an emergency, no notice will be given. If you have any queries about Your order, please email cs@earthykiss.com.

6.0 Cancellation/Return Policy


MY EARTHY KISS is committed to providing customers with outstanding customer service. Please feel free to WhatsApp +852 9792 9738 or email cs@earthykiss.com with the E-receipt or name and contact number for verification, Our team will try our best to provide helps and follow up.

 

6.1.   Any cancellation after an order is placed will be charged 6% of the purchase price and the platform's handling charge.

6.2.   All returns must be made at My Earthy Kiss Experience Station. Mail will not be accepted.

6.3.   All products must be returned under brand new, unopened and undamaged conditions, and must be returned with E-receipts at My Earthy Kiss Experience Station within 3 days after being received.

6.4.   Any product returned due to quality issues must be returned with E-receipts at My Earthy Kiss Experience Station within 3 days after receiving.

 

7.0 Exchange


We provide a 3-day replacement service for all products purchased from MEK. Customers can make an exchange with E-receipts provided at MY EARTHY KISS Experience Station within 3 days after products are received. Please ensure the exchange products are in good condition, otherwise, any exchange or refund will not be accepted.


All MEK products have been packaged and shipped in good conditions, so if the products are damaged after receipt, return or replacement are not accepted. MEK does not take the responsibility for any damage to the goods in transit. If you choose to receive the goods by express delivery, you agree to certain risks during the delivery process.

 

In case of any suspected deterioration of the product, please bring along the product together with the E-receipt to My Earthy Kiss Experience Station within 3 days after receiving the product. We will send them to the overseas lab for a detailed quality check. MEK will make a further decision depending on the results from the lab report, and MEK reserves the final decision of refunding/ exchanging the product.

 

8.0 Exchange & Refund Policy


8.1.     All products must be returned under brand new, unopened and undamaged conditions, and must be returned with E-receipts at My Earthy Kiss Experience Station within 7 days of purchase (except for overseas customers).

 

8.2.     If the cause of replacement is on Our side for overseas orders, which only includes missing or wrong products, My Earthy Kiss will be responsible for all freights. Otherwise, overseas customers should cover all shipping fees for their return products, while MEK will not take responsibility for it.

 

8.3.     All products should be exchanged in person at MY EARTHY KISS Experience Station with E-receipts.

 

8.4.     My Earthy Kiss will not provide an exchange service for opened products except those with quality problems.

 

8.5.     Opened or damaged products will not be returned.

 

8.6.     If there are any quality issues in your products, please send your order number together with a picture of the defective product to +852 9792 9738 or email to cs@earthykiss.com within 3 days after receiving. We will then look into the problem for You as soon as possible during office hours, or:

 

Local Orders: please bring the defective products over to My Earthy Kiss Experience Station, for Team My Earthy Kiss to check it up for You.

 

Overseas Orders: please send pictures of the defective products to +852 9792 9738 via WhatsApp, or email to cs@earthykiss.com for further inspection. If you wish for a new delivery of the products, the customer will have to bear all costs and risks.

 


9.0 Products that do not accept exchange


The exchange will not be accepted under the following circumstances:

9.1.   The product has been purchased for more than 7 days.

9.2.   The product has been opened (except deteriorated products) or has been used.

9.3.   If the customer is allergic to the purchased product, this needs to be proven by a doctor certificate to list out which specific ingredient is the allergen. Otherwise, MEK will not be liable for any liability or related costs.

9.4.   Product that is suspected to deteriorate but has already been opened or used. We guarantee that all products are authentic. If the customer suspects that the product may deteriorate and asks for a replacement or an exchange, we will send the product back to the relevant manufacturer or agent for further inspection and verification. The processing time is generally 40-60 working days. We are willing to accept the replacement service if the product is identified as bad.

9.5.   The product is not properly packaged, damaged, or incomplete.

9.6.   Any discounted product or special offer showing that returns are not accepted.

9.7.   Any freebies, accessories, and samples.

 

Return or exchange products that are found not in accordance with our replacement terms and refund policy will not be accepted. MEK reserves the final decision on all matters regarding return and exchange. We apologise for any inconvenience caused.

 

10. Exchange


Customers can only exchange their products once within the specified date under the same E-receipt. A second replacement is not allowed, and no refund will be accepted under any circumstances.

 

11. Prices Policy


The Company reserves the right to revise its prices at any time prior to accepting an Order.

 

The prices quoted may be revised by the Company subsequent to accepting an Order in the

event of any occurrence affecting delivery caused by government action, variation in Customs duties, increased shipping charges, higher foreign exchange costs, and any other matter beyond the control of the Company. In that event, You will have the right to cancel Your Order.

 

12. Trade


If the customer does not apply for any exchange and return within 3 days, the trade is seen as completed, and the Company will not assume any legal liability. Further return and exchange are not available.

 

13. Disclaimer


13.1.   The company is not liable for the quality of the gifts and free samples provided and does not provide an exchange service.

13.2.   The company is not liable for any problems arising from the improper use of the products.

13.3.    The company reserves all rights to suspend, change or cancel all offers, or amend all terms and conditions without prior notice.

14. User Accounts


When You create an account with My Earthy Kidd, You must provide Us with information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of Your account on Our Service.

 

You are responsible for safeguarding the password that You use to access the Service and for any activities or actions under Your password, whether Your password is with Our Service or a Third-Party Social Media Service.

 

You agree not to disclose Your password to any third party. You must notify Us immediately

upon becoming aware of any breach of security or unauthorised use of Your account.

 

15. Termination


We may terminate or suspend Your Account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if You breach these Terms and Conditions.

 

Upon termination, Your right to use the Service will cease immediately. If You wish to terminate Your Account, You may simply discontinue using the Service.
